OVERVIEW

On December 21, 2000, President Clinton signed the Legal Immigration and Family Equity Act (LIFE) into law.

The only applications and petitions that the Missouri Service Center will process are those related to the LIFE Act.

Do not send original passports or other valuable personal documents. Make copies of your original documents and submit the copies with the application/petition. All photocopies should be on 8 ² X 11 paper.

LIFE Act applications/petitions should be typed or computer printed, whenever possible, and assembled in the following order: G-28, primary application/petition (I-485, I-539, I-817, I-129F, etc.) and supporting documentation.

The correct mailing address and relating information, for LIFE cases filed at the Missouri Service Center, are as follows:

Material needed when filing the Form I-539 withImmigration Services

° Application must be completed and signed by Applicant. If dependents are included in filing, supplemental sheet must be completed for each dependent.

° Must attach correct fee.

° Primary applicant and each additional beneficiary, 14 to 79 years of age, must submit the correct Fingerprint Fee with their application. Processing cannot be completed until fingerprint results are received.

° Must submit a Form I-693 for each applicant included on the I-539 (Medical Examinations of Aliens Seeking Adjustment of status. (No vaccination supplement is needed).

° Must submit a copy of Receipt Notice (I-797) or other proof from the INS of a pending or approved Form I-130, Petition for Alien Relative.

° Must have all documents (correspondence) to or from the Service Center regarding the application (if lacking other evidence).

° If the Form I-130 is pending for a spouse, a copy of the marriage certificate is required to establish the relationship.

° If the Form I-130 is pending for a child, a copy of the birth certificate is required to establish the parent-child relationship.

° If the member is submitting the I-539 for an extension of the V status, the fingerprint fee and Form I-693 is not required.

Material needed when filing the Form I-129F with Immigration Services

° The I-129F for the K-3 member must be completed and signed by petitioner.

° A separate I-129F should not be filed for K-4. The MSC

is not authorized to process separate I-129F petitions for K-4 children. Any K-4 children must be listed on the reverse side of the I-129F K-3 Petition.
° If the I-129F includes children (annotated on the reverse side of the form) who have a relative visa petition (Form I-130) that is approved or still pending, a copy of the birth certificate is not required for MSC processing.
° Must attach correct fee.
° Must submit a completed and signed Form G-325A.
° Must submit ADIT-Style Photos (2): One for the petitioner and one for the beneficiary.
° Must submit a copy of Receipt Notice (Form I-797) or other proof from the INS for a pending or approved Form I-130, Petition for Alien Relative.
° If the relative visa petition (Form I-130) is approved or still pending for a spouse, submit a copy of the marriage certificate. This document is needed to establish place of marriage.

° Submit copies of legal documents reflecting any name changes (for example; marriage certificate, adoption decree, or court order).

Material needed when filing the Form I-485 withImmigration Services

° Application must be completed and signed by Applicant.

° Must attach correct fee.

° Must attach correct Fingerprint Fee if applicant is 14 to 79 years of age. Processing cannot be completed until fingerprint results are received.

° Must submit a completed and signed G-325A Biographic Data Sheet.

° Must submit ADIT photos (2).

° Must submit a Form I-693 (Medical Examinations of Aliens Seeking Adjustment of status. (No vaccination supplement is needed).

° Must submit evidence that the alien is a —Class Member“ in Catholic Social Services (CSS), League of United Latin American Citizens (LULAC), or Zambrano v. INS (Zambrano).

° Once the member has been identified as a —Class Member“ any riding I-765 and/or I-131 applications may be approved at MSC.

° Once the fingerprints have been cleared by the FBI, the I-485 is transferred out to the appropriate District/Local Office for interview processing.

Material needed when filing the Form I-817 withImmigration Services

° Application must be completed and signed by applicant.

° Attach correct fee.

° Must attach correct Fingerprint Fee if applicant is 14 to 79 years of age. Processing cannot be completed until fingerprint results are received.

° Must submit ADIT photos (2).

° Must be either the spouse or child (unmarried and under the age of 21) of an alien that has been identified as a —Class Member“ and that member has a LIFE I-485 case pending.

° Must submit appropriate marriage and/or birth certificates.

° The applicants must submit documentation, which show that they entered the U.S. prior to 12/1/88, and that on 12/1/88 they were residing in the United States.

Material needed when filing the Form I-765 withImmigration Services

° Application must be completed and signed by the applicant .

° Must submit correct fee.

° Must submit signature card and ADIT Photos (2).

° If applying under —V“ classification, must submit a copy of —V“ Visa in alien‘s passport or a copy of Arrival-Departure Record (I-94 form). EAD Classification: A15.

° If applying under —K“ classification, must submit a copy of —K“ Visa in applicant‘s passport or a copy of Arrival-Departure Record (I-94). EAD Classification: A9.

° If applying under LIFE Legalization, must submit a copy of Receipt Notice (I-797) of LIFE Form I-485 (pending). EAD Classification: C24.

° If submitting an I-817 as the spouse or child (unmarried and under the age of 21) of an alien that has been identified as a —Class Member“ and that member has a LIFE I-485 case pending, a separate I-765 is not required. Submission of the Form I-817, with proper fee and documentation entitles the member to an EAD Card. EAD Classification: A15.

Material needed when filing the Form I-131 with

Immigration Services

° Application must be completed and signed by Applicant.

° Must attach correct fee.

° Must submit evidence that the alien is a —Class Member“ in Catholic Social Services (CSS), League of United Latin American Citizens (LULAC), or Zambrano v. INS (Zambrano).

° If filed separately from the I-485, must submit a Receipt Notice (Form I-797) or other INS evidence of a LIFE I-485 pending.

° Must submit ADIT photos (2) for the production of the I-512L Travel Document.
